Terms of Service

1. Acceptance of Terms

By accessing or using Interview Whisper ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Interview Whisper is a desktop application that provides AI-powered real-time coaching for technical and behavioral interviews. The Service includes screenshot analysis, voice input processing, code review assistance, and algorithm help through artificial intelligence.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Accept all responsibility for activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Subscription Plans and Payment

4.1 Free Trial

New users automatically receive 10 free API calls upon registration. These trial calls are one-time only and do not reset. Once exhausted, you must subscribe to a paid plan to continue using the Service.

4.2 Subscription Plans

Interview Whisper offers Pro and Ultimate subscription tiers. Each plan has different features and usage limits as described on our pricing page. There is no free tier - after using your trial calls, a paid subscription is required.

4.3 Payment

Paid subscriptions are processed through Stripe. By subscribing, you authorize us to charge your payment method for the applicable fees. Monthly subscriptions automatically renew unless cancelled before the renewal date.

4.4 Price Changes

We reserve the right to modify subscription pricing. Price changes will not affect existing subscriptions during their current billing period. You will be notified of any price changes at least 30 days in advance.

4.5 Account Sharing and Access

Your account is for your personal use only. You may not share your account credentials with others or allow multiple people to use a single account. Each user must have their own subscription.

Important: Sharing your account credentials, using the Service for commercial purposes without a commercial license, or engaging in any form of account abuse may result in account suspension or termination without refund.

5. Refund Policy

5.1 Usage-Based Refund Eligibility

IMPORTANT: Once you have actively used the Service by making at least one (1) AI API call (including but not limited to screenshot analysis, voice input processing, or any AI-powered feature), your subscription is considered utilized and is NOT eligible for a refund.

5.2 Unused Subscription Refunds

If you have purchased a subscription but have NOT made any API calls or actively used any AI features, you may request a full refund within 30 days of purchase by contacting our support team.

5.3 Refund Process

To request a refund (if eligible), use the chat widget in the bottom right corner of this page with your purchase details. Refunds are processed within 5-10 business days to the original payment method.

6. Cancellation

You may cancel your monthly subscription at any time through your account settings or the Stripe customer portal. Cancellations take effect at the end of the current billing period. You will retain access to paid features until the end of your billing period. No refunds are provided for partial billing periods if you have used the Service.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any laws, regulations, or third-party rights
  • Engage in any fraudulent, deceptive, or manipulative activity
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service for any automated or bulk queries
  • Reverse engineer, decompile, or disassemble the application
  • Share your account credentials with others
  • Use the Service to harass, abuse, or harm others
  • Upload or transmit viruses or malicious code
  • Violate the terms of our AI providers (including OpenAI's usage policies)
  • Use the Service in any manner that could damage our reputation or business
  • Circumvent or attempt to circumvent any usage limits or access restrictions
  • Use the Service for any illegal, unethical, or prohibited purpose during interviews
  • Create multiple accounts to abuse trial API calls or promotional offers

Important Notice: You are solely responsible for ensuring your use of the Service complies with any applicable interview policies, employment agreements, academic integrity policies, or other contractual obligations. We do not endorse or encourage violation of any such policies.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Interview Whisper and are protected by international copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of any content you submit to the Service (screenshots, audio, etc.). By submitting content, you grant us a license to use, process, and analyze it to provide the Service.

9. AI-Generated Content

The AI-powered responses and coaching provided by the Service are generated using artificial intelligence and should be used as guidance only. We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

Important: You are responsible for verifying any information or code suggestions provided by the AI. Do not rely solely on AI responses for critical decisions or production code.

10. Privacy and Data Usage

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

11. API Usage Limits

Different subscription tiers have different usage limits. Free users are limited to a specific number of API calls per day. We reserve the right to enforce usage limits and may suspend or throttle service for excessive usage that violates fair use principles.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTERVIEW WHISPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

14. Indemnification

You agree to indemnify, defend, and hold harmless Interview Whisper and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, violation of these Terms, or violation of any rights of another.

15. Service Modifications and Discontinuation

15.1 Feature Changes

We reserve the right to modify, suspend, or discontinue any feature or functionality of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.

15.2 Service Discontinuation

In the event we decide to discontinue the Service entirely, we will provide at least 30 days advance notice via email to active subscribers. In such case, you may be entitled to a pro-rata refund for any unused portion of your prepaid subscription period, at our sole discretion.

15.3 Plan Modifications

We may modify subscription plan features, limits, or benefits at any time. Material changes to existing paid plans will be communicated with at least 30 days notice. Existing subscribers will have the option to continue with their current plan terms until the end of their billing period or cancel their subscription.

15.4 Plan Discontinuation

We reserve the right to discontinue any subscription plan at any time. In such cases:

  • We will provide at least 30 days advance notice via email
  • You may continue using the plan until the end of your current billing period
  • You will have the option to migrate to an alternative plan or cancel your subscription
  • If we force cancellation before the end of your billing period, you may be entitled to a pro-rata refund at our sole discretion
  • No refunds will be provided if you have the option to continue until your natural renewal date

15.5 Third-Party Service Dependencies

The Service relies on third-party providers (including OpenAI and other AI services). If a third-party provider discontinues their service, significantly changes their terms, or becomes unavailable, we may need to modify or discontinue features that depend on that provider. We are not liable for any disruption caused by third-party service changes and will make reasonable efforts to find alternatives or provide notice when possible.

16. Account Termination

16.1 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms of Service
  • Fraudulent or illegal activity
  • Violation of acceptable use policies
  • Non-payment or failed payment
  • Excessive or abusive usage of the Service
  • At our sole discretion for any other reason

16.2 Termination by You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You remain responsible for all charges incurred up to the cancellation date.

16.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account data after termination. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Interview Whisper operates, without regard to its conflict of law provisions.

18. Dispute Resolution

Any dispute arising from these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

20. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes or labor disputes, failure of third-party services (including OpenAI, cloud hosting providers, or payment processors), internet service provider failures, or communication infrastructure failures. In such events, we will be excused from performance for the duration of such circumstances.

21. Payment Processing and Taxes

21.1 Payment Processor

All payments are processed through Stripe, a third-party payment processor. By providing payment information, you agree to Stripe's terms of service and privacy policy. We do not store your complete credit card information on our servers. You authorize us to share necessary payment information with Stripe for processing purposes.

21.2 Automatic Renewal

Monthly subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method automatically on each renewal date. You will receive an email notification before each renewal. Failed payments may result in service suspension or termination.

21.3 Taxes

All fees are exclusive of applicable taxes unless otherwise stated. You are responsible for paying all taxes, duties, and other governmental charges associated with your use of the Service. If we are required to collect or pay taxes, such amounts will be charged to you in addition to subscription fees.

21.4 Promotional Credits and Discounts

We may offer promotional credits, discounts, or free trial periods at our sole discretion. These offers may be subject to additional terms and conditions, have expiration dates, and cannot be combined with other offers unless explicitly stated. We reserve the right to modify or cancel promotional offers at any time without notice. Abuse of promotional offers may result in account termination without refund.

22. Third-Party Services and Links

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by Interview Whisper. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services.

The Service integrates with third-party AI providers (including OpenAI) and other services. We are not responsible for the availability, accuracy, or content provided by these third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

We strongly advise you to read the terms and privacy policies of any third-party services you access through or in connection with the Service.

23. Beta Features and Experimental Functionality

We may offer beta, experimental, or preview features that are still under development. These features are provided "AS IS" without any warranties and may contain bugs, errors, or incomplete functionality. Beta features may be modified or discontinued at any time without notice.

By using beta features, you acknowledge that they may not work as intended and agree to provide feedback if requested. We are not liable for any issues, data loss, or damages resulting from your use of beta features.

24. Data Backup and Loss

While we implement reasonable data backup procedures, we do not guarantee that your data will be backed up or recoverable in all circumstances. You are solely responsible for maintaining your own backups of any important data or content.

WE SHALL NOT BE LIABLE FOR ANY DATA LOSS, CORRUPTION, OR INABILITY TO ACCESS YOUR ACCOUNT OR CONTENT FOR ANY REASON, INCLUDING BUT NOT LIMITED TO TECHNICAL FAILURES, SECURITY BREACHES, ACCOUNT TERMINATION, OR SERVICE DISCONTINUATION.

25. Export Compliance

You agree to comply with all applicable export and import control laws and regulations in your use of the Service. You represent that you are not located in, under the control of, or a national or resident of any country to which export is prohibited by law. You will not use the Service in violation of any applicable export restrictions.

26. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign, transfer, or delegate our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law. Any attempted assignment by you in violation of this section shall be null and void.

27. Waiver

No waiver by us of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

28. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Interview Whisper concerning the Service. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and us regarding the Service.

29. Notice Requirements

Notices to You: We may provide notices to you via email to the address associated with your account, through the Service interface, or by posting on our website. You agree that such electronic notices satisfy any legal requirement that communications be in writing. It is your responsibility to keep your email address current.

Notices to Us: Notices to us must be sent via email to legal@interview-whisper.com or by certified mail to our registered address. Notices to us are deemed received when we acknowledge receipt.

30. Interpretation

Section headings in these Terms are for convenience only and shall not govern the meaning or interpretation of any provision. The words "include" and "including" mean "including without limitation." If any provision of these Terms is ambiguous, it shall not be construed against either party as the drafter.

31. Survival

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification obligations, limitations of liability, dispute resolution provisions, and any other provisions that expressly or by their nature are intended to survive termination.

32. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
